A wrongful death lawyer works with someone who has survived a family member. This person (whether it be a spouse, parent, child, etc.) believes someone is responsible for the death of their loved one, and wants to be financial reimbursed, due to negligence on the part of the defendant(s). A wrongful death lawyer will take this case before a judge and argue that the defendant(s) were negligent and try to get monetary compensation. He or she must be ready to help his client get paid for damages and suffering caused by the death. As long as the deceased has surviving beneficiaries, a wrongful death suit can be filed.

The Wrongful Death Lawyer and Jurisdiction

It used to be that a wrongful death claim could not be sought, based in common law. States within the United States however, created their own wrongful death statutes, to allow beneficiaries of wrongful death victims to file against people who were the cause of death. Presently, every state now has some sort of wrongful death statute that people can use to seek damages.
