What is Workers' Compensation

Workers' Compensation is an employee benefit system set up by the government to insure all employees against injury, and in some cases illnesses, occurring on the job or as a result of the job. The employer is responsible for maintaining Workers' Compensation insurance, and bears the full cost of the premiums. Workers' Compensation benefits do not extend to independent contractors.

Workers' Compensation was originally devised to keep job-related injury cases out of the court system and to provide swift and fair relief to the suffering employee without regard to fault or responsibility. It doesn't matter whether the injury was incurred through the fault of the employer or the employee; the employee still has a right to collect benefits.

Each state governs its own Workers' Compensation program; laws and benefits vary by state. Jurisdiction is determined by the employee's job location, not his or her state of residence.

Depending on the severity of the accident, benefits include:
  • Temporary partial disability
  • Temporary total disability
  • Permanent partial disability
  • Permanent total disability
  • Mutilation/Disfigurement
  • Death benefits – payable to your beneficiaries

What should I do if I'm injured on the job?

As soon as practical after the injury occurs, you must submit completed forms to your employer, who will submit copies to the state board and the insurance company. At some point, you'll be required to visit an approved doctor for an evaluation and prescribed course of treatment. If the employer or the insurance company does not contest the claim, you'll receive compensation for medical bills, lost wages from the insurance company. If the employer contests the claim, a hearing will be held to determine what, if any, benefits you will receive.

If you're injured on the job, contact a qualified Workers' Compensation lawyer to handle your case and help you collect your benefits. The results of a Workers' Compensation hearing can affect you for the rest of your life. It is in your best interest to consult with a qualified Workers' Compensation lawyer immediately if you are injured on the job, particularly if the injury is serious.

Most Workers' Compensation lawyers bill clients on a contingency basis, so you will not incur any out-of-pocket expenses. At the very least, you should arrange for a preliminary consultation with a qualified Workers' Compensation lawyer to learn about your rights and benefits under your state's Workers' Compensation law.
